New divorce law - DIVORCE THE SOUSE’ SAYS INDIA’S HIGH COURT

Mumbai high court in India has termed withholding sex to a spouse as a form of cruelty and can be a ground for ending the marriage. The decision has angered rights advocates , saying the ruling does not take into account other issues.

At the heart of the issue was a case that allowed a man to divorce his wife because they were not having enough sex.

Justice Kailash Gambhir announced the verdict, upholding a lower court’s ruling of divorce to a man having a “sex-starved marriage” as his wife refused to have sexual intercourse with him on the wedding night and reportedly having sexual intercourse with her husband between 10 to 15 times over the subsequent five months.

INTERNATIONAL WOMEN’S DAY TODAY More and more women saying no to custody of kids after divorce

An increasing number of women have been refusing to own the responsibility of their children after divorce, bringing forth the changing facet of the idolised Indian mother.

The district police-run women cell has been getting cases wherein women are pouring in with a demand for separation. “In many cases, we have seen women having extra-marital affairs and leaving husband as well as children for the sake of the other man. Sadly, family is last thing on their list of priorities,” pointed out a sub-inspector at the women cell.

The cops pointed out that law favours women more and the women have started exploiting it.

“At the Bathinda Central Jail, many female undertrials are those who have been accused of killing their daughters-in-law or for abetting suicide. In a few of these cases, the females from in-laws’ family have been trapped by the girl’s family to avenge the death of their daughters,” said the jail authorities.

Divorce and Remarriage should be encouraged

We all have the rights to live our life the way we want. This should be done to avoid hurting the sentiments of people around us. Mistakes are made by humans and marriage can be of them.

For
Divorces in marriages are very common today. Divorce can occur due to many reasons like – incompatibility of partners, insecurity, violence etc.

Post a divorce, an individual has the right to live his/her life by marrying someone else again.

A marriage can be seldom forced on an individual. This may lead to an unsuccessful marriage.

A divorce could be traumatic for the individual. A new ray of hope could be a remarriage.

Marriage is socially acceptable in Indian society. For any individual, especially women, living alone can be socially traumatizing.

Once bitten twice shy. Divorce and remarriage should not be encouraged.

Marriage is supposed to be a life long commitment with one person.

Because the couple looses the ability to understand each other, a divorce occurs. It’s least likely the couple adjust with someone else.

Divorce and Remarriage pass negative vibes to children that may hamper their mental stability.

It creates a negative impression on family and relatives.

After remarriage, it takes time to adjust and expectations are raised.

In most cases, a divorce and remarriage should be avoided. The couple needs to understand that more than anything else, the children needs them the most.
